The first fundamental scientific research on franchising matters – this is how the author’s book “Franchising in theory and practice, comments on franchising agreement part in the Commercial Act” may be described, a topic substantial for the theory and practice of Latvian commercial law.
As of January 1, 2010, a new part in the Commercial Act “Commercial Transactions” will come into force wherein regulation is stipulated also for the franchising agreement. Therefore the recent publication of Ms.Jarkina “Franchising in theory and practice, commenting on the new regulation of the Commercial Act related to franchising agreement is essentially important. The author analyzes franchising as an aggregation of rights, which the franchisor grants to the franchisee for remuneration. The book in scrutiny looks upon the regulation of franchising not only from the viewpoint of the EU law, but also the law of North America and other countries.
Author analyzes the franchising agreement, i.e. what is the legal basis of establishing of franchising, analyzes the place of franchising agreement in the system of civil agreements, evaluates the types of franchising agreements from practice, describes the rights and obligations of the participants to the franchising agreement, as well as comments upon the legal regulation of the franchising agreement in the Commercial Act of Latvia.
